Payment Terms
• Payment is required in full at the time of booking. Please note that 30% will be retained if the booking is cancelled.
• A bond is required and will be refunded within 5 business days after collection, provided all items are returned in acceptable condition.
• Events by Jasmin Prescott reserves the right to deduct any amount necessary from the bond for cleaning, repairs, replacement, or late fees. If the cost exceeds the bond, the hirer agrees to pay the outstanding balance within 7 days of notification.
• If the hirer fails to pay any outstanding charges within 7 days of notice, Events by Jas reserves the right to pursue legal recovery action, and the hirer will be liable for any associated legal, collection, or administrative costs.
Hirer Responsibilities
• Items are the responsibility of the hirer from delivery until collection.
• Hirer must ensure items are protected from weather, theft, and damage.
• No adhesives, hooks, pins, paint, or alterations may be made to any hire item.
• If any item is damaged, lost, or returned excessively dirty, a repair/replacement fee will apply and may be:
• Deducted from the bond; or
• Invoiced to the hirer if costs exceed the bond.
• A copy of the hirer’s photo identification must be provided with this agreement. Events by Jas reserves the right to cancel any booking where identification is not provided.
• The hirer agrees to indemnify and hold harmless Events by Jasmin Prescottt and its representatives against any claims, damages, losses, or injuries arising from the use or misuse of hire items during the hire period.
• All items will be delivered/collected in clean and good condition. It is the hirer's responsibility to inspect items upon receipt and report any issues immediately.
Cancellation & Postponement
• Cancellations made within 7 days of the event will forfeit all payments made.
• Postponements are allowed once, subject to availability, and must be requested at least 14 days in advance.
• If the new date is unavailable, it will be treated as a cancellation.
Weather Disclaimer
• Events by Jasmin Prescott is not liable for damage caused by weather conditions, including wind, rain, or excessive heat.
• Hirer is responsible for suitable placement of all items to minimise weather risk.
Late Return or Access Issues
• A late collection fee of $50 may apply if items are not accessible at the scheduled pickup time.
• Hirer must notify Events by Jasmin Prescott of any venue restrictions (e.g. stairs, time limits).
Liability & Safety
• Events by Jas accepts no responsibility for injury or damage caused by the use or misuse of hire items.
• It is the hirer's responsibility to ensure safe and appropriate setup.
• Children should not climb or lean on decor items (e.g. plinths, arches).
Force Majeure
• Events by Jasmin Prescott is not liable for failure to provide services due to events beyond our control, including but not limited to:
- Natural disasters
- Pandemic or illness
- Vehicle breakdown
- Accidents or emergencies
In such cases, a full refund or reschedule will be offered.
Photo Use Permission
• Unless requested otherwise, Events by Jasmin Prescott may take photographs of the event setup and use them for marketing and social media purposes.
Agreement
• By making a booking or using our services, clients agree to these terms and conditions.
